Terms and Conditions of Trade

1. Definitions

1.1 “Colexions”, “we”, “us”, “our” refers to Colexions, including its successors, assigns, and authorised agents.
1.2 “You”, “Buyer” means the purchaser of any products from our website.
1.3 “Goods” refers to giftware products and any other items supplied by Colexions.
1.4 “Services” includes any services provided by Colexions, including advice or support.
1.5 “Price” refers to the amount payable for any Goods or Services, including GST where applicable.

2. Acceptance of Terms

2.1 By placing an order on our website, you agree to these Terms.
2.2 Amendments to these Terms must be agreed to in writing by Colexions.
2.3 If you are purchasing on behalf of a company, you confirm that you are authorised to do so.
2.4 You must notify us in writing within 14 days of any changes to your contact, billing, or delivery details.

3. Pricing & Payment

3.1 All prices are shown in New Zealand Dollars (NZD) and excluding GST unless otherwise stated.
3.2 Prices may change without notice. Shipping quotes are valid for 30 days from the date of issue.
3.3 Full payment is required before dispatch unless otherwise agreed in writing.
3.4 We accept Visa, Mastercard, debit cards, and other approved payment methods.
3.5 Credit card payments incur a surcharge of 2.7% + $0.30 per transaction.

4. Shipping & Delivery

4.1 Orders will be delivered to the address you provide at checkout.
4.2 Delivery fees are calculated after checkout and invoiced to the contact provided. Charges may vary depending on your region and order size.
4.3 You must ensure someone is available to accept the delivery at the nominated address, or there is a safe place for the courier to deliver your order.
4.4 Colexions is not responsible for delays caused by third parties or circumstances beyond our control.
4.5 Slight discrepancies in quantity (up to 10%) may occur, and any necessary adjustments will be made accordingly.

5. Risk & Title

5.1 Risk in the Goods passes to you upon delivery.
5.2 Ownership of Goods remains with Colexions until full payment is received.
5.3 Until ownership transfers to you, products must be kept identifiable and may not be sold or used as security.

6. Returns & Defects

6.1 You must inspect your order upon delivery and notify us of any issues within seven (7) days by emailing Hello@colexions.co.nz.
6.2 If we confirm a fault, we may offer to replace or refund the affected Goods.
6.3 No returns are accepted without prior written approval from Colexions.

7. Manufacturer’s Warranty

7.1 For all Goods not manufactured by Colexions, the applicable warranty is that provided by the original manufacturer.
7.2 Colexions does not offer any additional warranty beyond the manufacturer’s coverage. All warranty claims must comply with the terms and conditions set out by the original manufacturer.

8. Liability

8.1 Colexions is not liable for indirect or consequential loss, including loss of income or profits.
8.2 Our total liability under these Terms is limited to the Price paid for the relevant Goods.

9. Order Cancellations

9.1 You may cancel your order prior to dispatch by contacting us at Hello@colexions.co.nz.
9.2 Once an order has been dispatched, it cannot be cancelled.
9.3 Due to health and safety regulations, and the sanitary nature of certain products, we are unable to accept returns for change of mind.
9.4 Refunds will only be considered for faulty or damaged products and must be reported within seven (7) days of delivery.
9.5 All refund or credit requests are subject to review and approval at the sole discretion of Colexions staff.

10. Consumer Guarantees Act 1993

10.1 If you are purchasing Goods for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply.
10.2 If you are purchasing for personal use, your rights under the Act remain fully protected.

11. Privacy

11.1 We collect personal information to fulfil orders, communicate with you, and improve our services.
11.2 Your information may be shared with third-party service providers such as payment processors or couriers.
11.3 You may request access to or correction of your personal information by contacting Hello@colexions.co.nz.

12. Governing Law

12.1 These Terms are governed by the laws of New Zealand.
12.2 Any disputes arising under these Terms will be dealt with in the New Zealand courts.
12.3 If any clause in these Terms is found to be invalid, the remainder will continue to be enforceable.

13. Changes to Terms

13.1 We may update these Terms at any time by publishing a revised version on our website.
13.2 Continued use of our website or placement of further orders implies acceptance of any updates.

14. Product Display on Screen

14.1 We make every effort to display our products accurately on our website. However, colours may appear differently depending on your device’s screen settings and lighting conditions.
14.2 Such variations in colour or appearance do not constitute a fault in the product and will not be considered grounds for return or refund.
